1. Acceptance of Terms

By accessing or using the website located at claimsmaximizer.com (the “Site”) and the claim-building tool accessible through it (the “Service”), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. Description of Service

Claim Maximizer provides a portfolio of online tools that generate personalized consumer-claim documents — including demand letters, evidence checklists, escalation templates, and related materials — based on information you provide. The Service currently includes four tools:

• Auto Insurance Claim Builder (/app) — covers seven claim types: diminished value, rental car reimbursement, total loss / ACV disputes, uninsured/underinsured motorist claims, medical payment disputes, lost wages, and personal property damage.
• Security Deposit Recovery (/deposit-recovery/) — generates state-specific demand letters and small-claims kits for recovering residential security deposits in all 50 states and DC.
• Medical Bill Negotiation (/medical-bill-tool/) — generates negotiation letters and guides for disputing medical bills under HIPAA, the No Surprises Act, 501(r), FDCPA, and ERISA.
• WA Property Tax Appeal (/property-tax-wa/) — generates Board of Equalization appeal packages for Washington State property owners across all 10 covered counties.

3. Not Legal Advice

Claim Maximizer is not a law firm and does not provide legal advice. The documents, templates, information, and guidance provided through the Service are for informational and educational purposes only. They do not constitute legal advice, and no attorney-client relationship is created by your use of the Service.

Insurance laws vary by state and individual circumstances differ significantly. The Service provides general information and document templates that may not be appropriate for every situation. For complex claims, disputes involving significant amounts, or situations where you believe your insurer is acting in bad faith, we recommend consulting a licensed attorney in your state.

4. No Guarantee of Results

Claim Maximizer does not guarantee any specific outcome from using the Service. The success of any insurance claim depends on many factors outside our control, including your state’s laws, the specific insurer involved, the facts of your accident, the quality of your supporting evidence, and the judgment of adjusters, mediators, or courts.

Any examples, testimonials, or typical outcomes referenced on the Site are illustrative and do not guarantee that you will achieve similar results.

5. User Responsibilities

You are responsible for:

• Providing accurate and truthful information when using the Service
• Reviewing all generated documents before sending them to any party
• Ensuring that your use of the generated documents complies with applicable laws in your state
• Making your own decisions about whether and how to pursue your insurance claim
• Keeping your access code secure and not sharing it with others

You agree not to use the Service to generate fraudulent, misleading, or dishonest claim documents. Submitting a false insurance claim is illegal and may result in criminal penalties.

6. Purchases and Access

Each tool in the Service is sold at a fixed, one-time price, processed securely through Stripe. Pricing and access duration as of this version:

• Auto Insurance Claim Builder: Starter ($29, single claim type, 6-month access) or Pro ($49, all seven claim types, 12-month access).
• Security Deposit Recovery: Letter ($15, 12-month access) or Kit ($29, 12-month access with small-claims and attorney-general escalation templates).
• Medical Bill Negotiation: Guide ($9, 12-month access), Letter ($29, 12-month access), or Full Kit ($49, 12-month access with all templates and escalation paths).
• WA Property Tax Appeal: Appeal Kit ($49, 12-month access covering all 10 supported counties).

Higher tiers within a tool include the lower tiers at no additional cost (e.g., the Medical Bill Kit includes the Letter and Guide). After purchase, you will receive an access code by email. This code grants you access to the purchased tool for the duration of your plan. Access codes are non-transferable and scoped to the tool they were issued for.

7. Refund Policy

Due to the nature of the Service (instant delivery of digital content), all sales are final. We do not offer refunds after an access code has been delivered. If you experience a technical issue that prevents you from using the Service, contact us at hello@claimsmaximizer.com and we will work to resolve it.

If you believe you were charged in error or did not receive your access code, contact us within 7 days of purchase.

8. Intellectual Property

All content on the Site — including text, design, code, graphics, logos, and the underlying claim-generation algorithms — is the property of Claim Maximizer and is protected by applicable intellectual property laws.

Documents generated for you through the Service are yours to use for your personal insurance claim purposes. You may not resell, redistribute, or commercially exploit the generated documents or the Service itself.

9. Limitation of Liability

To the maximum extent permitted by law, Claim Maximizer and its owner(s), operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Service.

Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid for the Service.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

11. Third-Party Services

The Service integrates with third-party services including Stripe (payment processing) and Zoho Mail (email delivery). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of third-party service providers.

12. Partner/Affiliate Program

If you participate in our referral partner program, you agree to promote the Service honestly and ethically. You may not make misleading claims about the Service, guarantee specific outcomes, or use spam or deceptive marketing practices. We reserve the right to terminate any partner relationship and withhold payouts for violations of these terms.

13. Modifications to Terms

We may update these Terms of Use from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated via the Site or by email to active users.

14. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Service shall be resolved in the state or federal courts located in Washington State.
